身在美国境内的H-1B受益人，可在H-1B申请中，通过同时申请境内转换身份的方式，来获得H-1B身份。此种情况，H-1B受益人无需出境即可激活H-1B身份。
身在境外的H-1B受益人，或提交H-1B申请后（申请审理期间）离境美国的受益人，或在H-1B申请中选择了境外转换身份的受益人，需在H-1B申请被移民局批准后，在美国驻海外使领馆面签取得H-1B签证并入境后，其身份才将正式被变更为H-1B。
目前，美国对已完全接种WHO紧急授权疫苗，且出示24小时内新冠病毒阴性检测证明的外籍公民开放入境。不同使领馆的预约程序可能会有所不同，H-1B申请顺利批准后，身在境外的受益人可在美国国务院网站查询各使领馆面谈预约的等待时间。

受益人在获得H-1B签证后，携带有效的H-1B签证页、H-1B批准函、雇佣关系证明信、工资单等材料，在入境时向美国海关及边境保护局(CBP)的工作人员展示，即可进入美国境内工作。
