持有美国工作签证的外籍劳工可以选择在境外为美国公司工作,但需遵循所在公司对境外远程工作的相关规定,以及确保离境后能克服可能存在的时差及系统登录异常等问题,正常开展日常工作。
需要特别指出的是,美国移民法没有域外效力,即如果外籍员工在境外为美国公司工作,雇主及雇员双方无需遵守H-1B申请中所陈述的工作内容及薪资标准;外籍员工在美国境外期间,也将不累计其H-1B身份的使用时间。当员工持工作签证返回美国后,H-1B雇主和雇员的雇佣关系即刻生效,员工只可为其提供H-1B签证支持的雇主工作,雇主也需根据LCA上的现行工资标准向员工支付薪水。
